Examples of Crimes That Will NOT Automatically be Expunged:

Misdemeanors that are eligible for automatic expungement will be expunged seven years after the imposition of sentence or completion of any term of imprisonment, whichever occurs last. Felonies that are eligible for expungement will be expunged ten years after the imposition of sentence or completion of any term of imprisonment, whichever occurs last. The Automatic Expungement Process also has a limit to the number of convictions that will be expunged.

  • Serious misdemeanors
  • Assaultive crimes
  • Crimes of Dishonesty
  • Any violation of human trafficking
  • If a person has a conviction for more than 1 assaultive crime, none of their crimes will be automatically expunged

Examples of Crimes That ARE Eligible for Expungement:

  • OWI First Offense 
  • Many Assaultive Crimes
  • Criminal Sexual Conduct in the Fourth Degree (with exceptions)
  • Most Traffic Convictions

Application Expungement Process

Under the Application Expungement Process, up to three felonies can be expunged and there is no limit to the number of misdemeanors that are eligible.
